    • Data relating to Third Parties : surname, first name, date of birth or any other element that can be integrated by a User on a Customizable Product;
    • Data on your preferences and interests: number of rooms, number of adults and number of children, type of room, etc.;

    • Billing details: surname, first name, address, order details, discount, billing amount, amount of discounts and advantages, payment date, payment incident, payment method used, possible litigation;

    • Data related to User reviews and comments:  reviews, ratings, etc.;
    • Use of technical cookies and those that are strictly necessary for delivery of a Service expressly requested by the User or the Third Party

    • Monitoring and marketing data: IP address, Connection data (dates, number of connections);

In addition, each employee of PETIT-FERNAND agrees to comply with a strict security and non-disclosure policy.

In summary, PETIT-FERNAND implements legal and organisational elements to ensure the best possible protection with regard to the types and purposes of Personal Data collected in order to protect said Data against alteration, accidental or unlawful loss, use, disclosure or unauthorised access.

In this regard, PETIT-FERNAND attaches fundamental importance to:

  • Raising employees' awareness of confidentiality requirements;
  • Agreement from its subcontractors to comply with their non-disclosure obligations;
  • Securing access to its premises and IT platforms;
  • Securing of access, sharing and transfer of Data;
  • Implementation of a general IT-security policy;
  • A demanding selection of partners and service providers based on their compliance with the GDPR.

 

  • SECURING EXCHANGES ON THE WEBSITE

In order to ensure greater protection of the exchanges carried out through our Site, we have chosen to secure the latter by means of a TLS 1.2, 128-bit key.

The use of this encryption key and this certificate makes it possible to secure the exchanges carried out via the Site, in order to access the various Features.

In addition, all Subcontractors selected by PETIT-FERNAND have declared that they comply with their obligations in this regard and are subject to an obligation of confidentiality.

 

  • CONCERNING THE DATA RELATING TO ONLINE PAYMENT

When processing Data in order to benefit from the Services, the service providers that are Subcontractors mandated by PETIT-FERNAND (such as the payment provider, etc.) receive, exclusively, the data necessary for execution of their own service.

The Data thus transmitted can be used by our service providers only for execution of the assignments entrusted to them by PETIT-FERNAND.

PETIT-FERNAND only collects Personal Data concerning your contact details, an email address and the means of payment used.

 

  1. FOR WHAT LENGTH OF TIME CAN MY DATA BE RETAINED BY PETIT-FERNAND?

As a matter of principle, PETIT-FERNAND deletes the Data collected at the end of the contractual relationship, namely as soon as the User closes his Account, if applicable.

In the event of inactivity of the User Account (no connection to the Site, etc.) for a continuous period of 24 months, the Data collected will be deleted in a secure manner. Prior to this deletion, PETIT-FERNAND may have to request the User's consent in order to continue to benefit from his Account, which would imply retention of the Data by PETIT-FERNAND.

In the absence of a positive response from the User, the Data will be automatically deleted permanently and securely, with the exception of certain Statistical Data which will be made anonymous and may be used to improve the customer experience of PETIT-FERNAND.

It is specified that in the event of deletion of the User's Account, all the Data present will be deleted, with the exception of Personal Data that may be retained by PETIT-FERNAND on the basis of the legal obligation and with regard to standards applicable to the processing in question.

At the end of the aforementioned retention periods, PETIT-FERNAND will delete all Personal Data permanently and securely.

Personal Data printed on paper will be securely destroyed, including by cross-shredding or incineration of paper documents or otherwise and, if saved in electronic form, will be destroyed.

PETIT-FERNAND also reserves the right to retain anonymised statistical data for a period longer than the periods mentioned above.

 

  1. DOES PETIT-FERNAND COLLECT “SENSITIVE” DATA AND/OR DATA RELATING TO CHILDREN?

It is recalled that PETIT-FERNAND operates an activity of creation, customization, manufacture and delivery of Products on printed media.

It is recalled that "sensitive" Data are defined as follows by the GDPR:

« Information concerning racial or ethnic origin, political, philosophical or religious opinions, trade union membership, health or sex life. In principle, sensitive data can only be collected and used with the explicit consent of individuals.”

In this regard, PETIT-FERNAND specifies that it is, in principle, not required to collect sensitive Data transmitted by the User at the time of order placement or when entering his preferences.

The Sensitive Data that may be collected by PETIT-FERNAND will only be collected through the creation tools made available to the User.

In this regard, the User agrees not to communicate any sensitive information and Data concerning himself or a Third Party when customizing the Product, and to limit the information and Data transmitted on the site to that which is strictly necessary.

With regard to Personal Data concerning minors, it is also recalled that Recital No.38 of the GPDR provides that:

« Children deserve specific protection with respect to their Personal Data because they may be less aware of the risks, consequences and safeguards involved and of their rights related to the processing of Personal Data. This specific protection should, in particular, apply to the use of Personal Data relating to children for marketing purposes or the creation of personality or user profiles and to the collection of Personal Data relating to children when using services offered directly to a child. The consent of the holder of parental responsibility should not be necessary in the context of preventive or counselling services offered directly to a child.

It is thus recalled that Article 7-1 of the French Data Protection Act sets the age limit for the use of Personal Data at 15 years.

It is recalled that the creation of a Customer Account is reserved for adults.

Furthermore, PETIT-FERNAND does not intend to collect Personal Data from persons under 15 years of age, with the exception of the Data that may be entered by the User at the time of his order (First name, last name, date of birth).

As a first step, the User must ensure the use of recognized and up-to-date Internet access programs, including the various ancillary modules allowing access to the Services.

It is recalled that during the entire contractual relationship between the User and PETIT-FERNAND, that is to say during the period during which the User holds a personal account, PETIT-FERNAND may send the User advertising offers by email or SMS, for the purpose of prospecting for products and services similar to those of PETIT-FERNAND, or if the prospecting is not of a commercial nature.

The user will have a means of opposing the receipt of prospecting emails or SMS free of charge by simply unsubscribing from the emailing database of PETIT-FERNAND, by clicking on the button intended for this purpose which is present in each communication sent by PETIT-FERNAND.

In any case, each email sent by PETIT-FERNAND will be signed and will clearly indicate the identity of its author, as well as a method of unsubscribing.
